The Customer (hereafter named “you” or “your”) and Absorb Iceland ehf., registered at Rosarimi 1, 112 Reykjavik, Iceland, with CRN 691221-0400 and VAT no. 143439 (hereafter named “Absorb Iceland”, “we”, “our” or “us”), agree to enter into the following:

Overview

These Terms & Conditions may be amended from time to time and applies to all of our services.

By accessing, browsing, using, and/or completing a reservation through our website www.absorbiceland.is you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below. The customer making the booking accepts these conditions on behalf of all members of their travel party and is responsible for payment due from the party in its entirety.

Absorb Iceland is a tour operator, offering a wide range of private tours in Iceland. Bookings can be made directly through our website and/or any other website through which we make our services available. If you are having trouble booking through our website, please contact Absorb Iceland.

Please make sure to fill in and/or provide all necessary details upon booking with us. Once you have completed the booking process, a booking confirmation will follow, containing your booking reference number and the voucher(s) for the services booked. Please note that you are responsible for carefully checking all details on your confirmation and related travel documents to ensure they are correct. In the event of a discrepancy, such as booking mistakes where the wrong date and/or the incorrect number of participants was booked, please contact Absorb Iceland immediately as it may not be possible to make amendments to your reservation when it gets closer to your departure date. We cannot be responsible for mistakes in the booking process.

We reserve the right to alter itineraries and/or timetables should it be necessary, due to adverse weather and/or other related conditions (including force majeure). We will always work through these changes with you to come up with a suitable solution. We are not responsible for expenses and/or other related costs due to factors outside of our control, such as flight delays, changes and/or cancellations, injuries, weather, war, economic effects, natural disasters, pandemics, and other public health concerns, etc. and/or other unforeseeable matters. You are responsible for providing us with your correct contact information and related details so that we can keep you informed in the event of changes made to the services booked.

1. Prices and payments

1.1. We accept all major credit and debit cards. Purchases made via a credit/debit card will go through 3D Secure. We require the full amount at the time of booking.

1.2. Please note that all prices for services provided by us are in the company’s local currency, Icelandic Krona (ISK) unless otherwise stated. Any pricing advertised in local currency on our website or through resellers, booking agents, and travel agencies approved by us is subject to exchange rate fluctuation. Therefore, any price not advertised in ISK must be taken as indicative only with the ISK price taking precedence.

1.3. You can view an estimate of ISK prices in USD, EUR, and other currencies on www.xe.com. This is only to help you understand the approximate price. Your card will always be charged in ISK. We also refund in ISK. Since we do not charge any booking or transaction fees, we cannot be held liable for any losses due to fluctuations in currency exchange rates during transactions, nor any third-party transaction fees that may occur at the time of your payment and/or refund. Keep in mind that your card issuer may charge you a foreign transaction fee. As a local operator, we cannot be responsible for currency fluctuations and/or additional fees outside our control that may be applied, such as bank fees, transfer fees, credit card fees, etc.

1.4. All prices mentioned on our website are current prices and include value-added tax (VAT). We reserve the right to alter or change already published prices on our website without prior notice in case of economic changes, including but not limited to, currency fluctuation, inflations, increased cost of supplies, government taxes, force majeure events, or any such cost increases which are outside our control. Prices are guaranteed against any surcharge after an invoice has been issued unless the increase is due to government laws or currency changes and amounts to 5% of the tour price or more. The amounts that exceed 5% will be charged and you will be entitled to cancel your booking with a full refund if the surcharge exceeds 10%. Any increase due to changes in government laws, i.e., tax changes, will be added to the invoice. In case of VAT or other tax changes, prices will change accordingly. Price changes affected by tax changes will apply to all reservations, although reservations have been confirmed on previous prices or payment has already been made. All prices are inclusive of VAT and are subject to any official tax changes.

2. Special offers, promotional codes, and gift cards

2.1. Any promotions held outside our website by resellers, booking agents, and travel agencies cannot be applied to any direct bookings with us. All sales of gift cards by us are delivered by e-mail after the purchase is completed. All gift cards are charged upon sale and are non-refundable in all circumstances, but can be transferred to someone else.

2.2. Please note that all special offers such as promotional codes only apply to the price of the tour and cannot be applied afterward in the form of a refund. When offered, promotional codes and/or other special offers must be entered into the relevant field located on the payment page upon checkout at the time of booking to be valid and applied. Extra bookable activities and rental gear are not subject to discount.

3. Pick-up and drop-off services

3.1. We offer pick-up and drop-off services for most of our tours. Please read the tour descriptions very carefully to see if pick-up and drop-off services are included in the price, can be added as extras, or if the tour/activity in question only offers the option of meeting us on location.

3.2. You as the traveler are responsible for your pick-up, which includes providing us with your preferred pick-up location in time, as well as being ready at the correct time for the pick-up of your tour. We do pick-ups and drop-offs within the Reykjavik Capital Area. If your hotel or accommodation is located in a walking zone, or where tour operators are not allowed to do pick-ups/drop-offs in the downtown area of Reykjavik City, you will be assigned your nearest bus stop location. We will provide you with information on your pick-up time and location on your voucher which is provided upon booking. If you are unsure when to be ready for your scheduled tour, please contact Absorb Iceland.

3.3. Please note that missing the pick-up does not entitle you to a refund of the price paid for the services. You are responsible to be ready for pick-up at the assigned pick-up point from the start of the pick-up time to not miss our guides when they arrive to pick you up. Be sure to provide us with ways that we can contact you whilst in Iceland so that we can find you if necessary. If you have missed the start time for your tour, you are not entitled to a refund. However, when possible, we will try to reschedule your tour for another day. This is not guaranteed and is subject to availability. It is your responsibility to reach out to us if you have missed your tour to request a rescheduling.

3.4. For some of Absorb Iceland’s tours, we can organize pick-ups outside of the Reykjavik Capital Area if in the direction of the tour, with sufficient notice. Be sure to get written confirmation with an alternative pick-up point and time. Please contact Absorb Iceland to work out if this is possible for your tour.

4. Meeting us on location

4.1. You as the traveler are responsible for arriving at the meeting point in time for your tour.  This includes being ready at the correct time at the correct location in time for your tour. We will provide you with information on the meeting point for your tour on the voucher provided upon booking. If you are unsure when to arrive for your scheduled tour, please contact Absorb Iceland.

4.2. Please note that if you do not arrive in time for your tour and/or do not arrive at the correct meeting point at the specified time for your tour, you are not entitled to a refund of the price paid for the services. If you have missed the start time for your tour, you are not entitled to a refund. However, when possible, we will try to reschedule your tour for another day. This is not guaranteed and is subject to availability. It is your responsibility to reach out to us if you have missed your tour to request a rescheduling.

5. Extra bookable activities and rental gear

5.1. Extra bookable activities and rental gear can be added upon booking some of our tours. If you have already made a reservation with us and would like to add any extra bookable activities to your reservation or require rental gear, please contact Absorb Iceland in time for your tour to guarantee availability. Payment can be made through payment links online with a card.

5.2. Please note that all extra bookable activities operated by our partners and rental gear reservations are subject to the partners‘ cancellation terms. This includes single supplements, hiking shoes, waterproof clothing, etc. After the tour departure, the extra bookable activities and rental gear reservations become non-refundable. 5.3. Safety equipment needed for extra bookable activities, such as glacier equipment, is provided by our partners and is not classified as rental gear.

6. Travel insurance

6.1. As with all world travel, we strongly recommend that you purchase a travel insurance policy before traveling to cover your cost should you have to cancel your travel reservation with short notice. It is your responsibility to take out comprehensive travel insurance that covers all eventualities including force majeure, flight cancellations, and other disruptions to your travel.

7. Icelandic weather and conditions

7.1. All tours and outdoor activities are dependent on weather and general conditions, which can change quickly in Iceland, particularly in winter. We reserve the right to change routes, itineraries, and departure times, or cancel your tour with your and our guides’ safety in mind, should the necessity arise. If we cancel your tour due to weather or unforeseen events, you will be refunded in full. If you cancel your tour with the weather in mind, you will not be entitled to a refund. Any tour that goes ahead will have taken weather and safety into account.

7.2. Please keep in mind that the weather can change fast in the northern hemisphere and with it, road and travel conditions can change. This is especially valid for traveling during winter in Iceland. Our guides are experienced in dealing with changing conditions and their number one priority is to make decisions with your safety in mind. Please be aware of this and respect our guides’ authority to do so.

8. Clothing

8.1 Appropriate footwear and suitable outdoor clothing must be worn. We reserve the right to refuse participation to you if you are dressed inappropriately or with inappropriate footwear, as this can put your well-being and safety at risk.

8.2 Although specific clothing types are not expressed here, it is important to consider that the Icelandic weather forecast is changeable and temperate. This means clothing should account for wet, windy, and cold weather, even in summer. Our partner’s guides will have the final say in allowing you to take part in any of their extra bookable activities based on your preparedness for the tour. You will not be eligible for a partial refund in the case that your suitability stops you from taking part in any extra bookable activity.

9. Assumed risk and outdoor activities

9.1. You are advised that all extra bookable activities are undertaken entirely at your own risk and you must behave in a fit and proper manner at all times by our or our partners’ guidelines. You must take full responsibility for your safety. All tours and outdoor activities carry inherent risks and we or our partners do not assume any responsibility for accidents that are caused by you or can be traced to your actions or are caused by factors outside of human control (force majeure). With the purchase of your tour and extra bookable activity, you agree to these conditions, understand its implications and accept responsibility for your participation in the tour. It is your responsibility to fully read the tour description that details what each tour entails. If you are unsure whether you can take part in all activities it is your responsibility to contact Absorb Iceland before the tour to cover any uncertainties. Depending on the extra bookable activity, you may be requested by our partners to sign an additional liability waiver or medical disclosure form.

9.2. Our guides reserve the right to refuse your participation if they believe you will not be able to complete the tour because of your physical condition, injury, or illness. In such cases, full cancellation charges apply.

9.3. We reserve the right to refuse participation to any customer that is being physically or verbally abusive, or if you pose a threat to our guides or others in any other way. In such cases, full cancellation charges apply.

10. Alcohol and drugs

10.1. We reserve the right to refuse participation to any customer who we believe is under the influence of alcohol or drugs. In such circumstances, no refund shall be given. Our guides reserve the right to refuse participation to any customer whose conduct or manner is likely to offend, upset or put others or our guide in danger. In such cases, full cancellation charges apply.

11. Reviews and feedback

11.1. We welcome all feedback to improve our overall services and performance. We would greatly appreciate it if you could share your tour experience with us.

12. Liability

12.1. Please note that we cannot be held responsible for damaged luggage if it is taken on the tour.

12.2. We cannot be held responsible for any losses, expenses, damages, accidents, injuries, sicknesses, schedule changes, or other factors due to weather, war, strike, natural disasters, or any other unforeseeable causes beyond our control (force majeure). We act in good faith and cannot be held responsible for defaults or delays of organizations such as individual agencies, hotels, other tour operators, resellers, bookings agents, airlines, guides, restaurants, or any other person‘s or company‘s act.

12.3. In the case of any changes to flights (domestic and international), you are responsible for any additional costs incurred as a result of such changes (i.e., additional hotel nights, meals, transfers, etc.), at the time provided. We, therefore, advise all customers to have comprehensive travel insurance to meet all contingencies.

12.4. The estimated duration of tours as indicated on our website are standard times and can vary according to the road and/or weather conditions, and if any extra bookable activity is added to the tour. Punctuality is a key objective of our operations. However, delays may occur for unforeseen reasons. We cannot be made responsible for losses that you may face due to delay, regardless of whether the loss is direct or indirect.

13. Governing law and jurisdiction

13.1. These terms and conditions are subject to Icelandic laws, rules, and regulations.

13.2. Any disputes arising out or in connection with this agreement shall exclusively be submitted to and dealt with by the District Court of Reykjavik.
